The new regulations are not printed in the 10/07 update of the IEP. However, they are in law and we have it in print from a Hodgson Ross Workshop.
The new Regulations indicate that only the district, a parent of the student or the commissioner or designess of a public agency responsible for providing education to SWD can refer. There was much discussion about district with multiple school being able to have more than 1 designee. The language seems to support RtI and the classification of LD. The instructional leader needs to assure that scientifically based interventions have been applied prior to classification.
